R v S - Assisting unlawful entrance
Mohammed Ullah of ULA Solicitors represented S who was charged with assisting a family member to gain entry into the UK illegally by using a British passport belonging to a third person without their knowledge.
The illegal immigrant was questioned by the police at the airport and was accompanied by S.
The case was prepared thoroughly with statements being taken from various individuals in support of S. In addition, medical evidence was obtained which confirmed S was suffering from ill health at the time. The judge accepted the points made on behalf of S and as a consequence S was sentenced to 12 months imprisonment suspended for 18 months and 300 hours of unpaid work. It was accepted that S committed the offence on humanitarian grounds.
